Is it true that the court leans towards giving the mother custody of the kids?

My brother is going to fight for the kids, and he's worried that he wont win. Is it true that the mother always gets them? Any advice?Is it true that the court leans towards giving the mother custody of the kids?
Greetings! Your brother needs an attorney NOW! He needs to lay out just exactly what went on in the marriage, why it failed and why he should be the one to reward custody to, not the mother. She is liable to do the same, if she hasn't already.





Unfortunately for everyone involved, your brother and his ex are about to engage the ugliest mudslinging they can possibly muster. When the fighting is done, it will be up to the judge to decide.





It is true that most often, child custody cases are rewarded to the mother. Unless he can PROVE her to be unfit (which is very difficult to do), the courts are slanted to the mother.


Many attorneys suggest to the men that they just try for joint custody and not go through that agony.





Its very sad...very horrible (especially for the children), but it's the way the system is.

Depending on the circumstances, and the judge, the courts will usually lean towards the parent most fit. If one has an drug and/or alchol problem, the other parent has a better chance. Finacials are also looked in too, who can provide better, etc...
Most of the time unless she is proved unfit.
In michigan they released some numbers and it was 90 / 10 percent split mothers to fathers.
now days the courts are leaning toward the father s which is so good for i personaly know alot of mothers that didnt need there children and the father could do better , my boys tryid living with there father but he brought them back for it was to much reaponsiblity for him ,, no child suport or nothing to help me ,their raised and adults now and they remember it all ..hope and wish your brother lots of luck and if hes a good father than may god help him get them ,,
From what I understand the primary parent will get custody. Traditionally that has been the mother but not always. Anymore single fathers are getting custody of their children because they are the primary parent. I know of several and it seems to be a growing trend in America. Document everything and get with the best lawyer possible.
Get the best lawyer and make sure you got your facts together. If she is unfit or has drug or acohol issues then he has a chance, however if she is a good mom probly want get them. He need a stable him for them and the financial backing and show that to the judge. What i would go for is primary custody and not try to get them totally, cause unles she is really bad, you want get them 100% but primary parent makes alot of decissions, and has alot of control
